This matter was settled by the European Court of Human Rights in the Idris Francis case, whose defence rested on 'a right to silence'.

It is the responsibility of the registered owner or keeper of a vehicle to inform the authorities of who was driving at the time of an offence.

The law (under Section 172 of the Road Traffic Act 1988) requires that the registered keeper must identify the driver.

The registered keeper could face £60 fixed penalty and six penalty points if he or she does not identify the driver who has committed the speeding offence.
