What Car? Q&A - Are garages obliged to refund parts?

01 February 2007
Q: Did you know Chrysler/Jeep dealers will not exchange parts bought by customers, even if they have been ordered by mistake.

I bought some parts one of which was wrong. I asked the dealer if I could exchange it for the correct part.

I was told it was Chrysler/Jeep policy not to exchange parts or refund money on parts returned.

Are they breaking the law by not exchanging the part or refusing to give me a refund? The part is new and not been used.

You are only entitled to a refund if the goods are faulty, not as described, or not fit for purpose.

If they are not suitable, you are only entitled to a refund if you told the dealer what you wanted the parts for, and they supplied something unsuitable.

In most cases retailers will exchange or refund goods bought in error as a mark of goodwill, but they are not obliged to.
